General Terms and Conditions of Trade
1. Subject of the General Terms and Conditions of Trade
The General Terms and Conditions of Trade regulate all contracts between private customers, hereafter referred to as the “customer” and plasticpop - Susanne Lork und Karsten Wassermann GbR, hereafter referred to as “plasticpop“, which are concluded through the plasticpop onlineshop. Deviating and/or supplementary agreement, especially conditionts of purchase of the customer are only a constituent part of the contract if these are expressly approved by plasticpop in writing. The General Terms and Conditions of Trade having validity at the time of conclusion of the contract have validity. The latest version of the General Terms and Conditions of Trade is on the plasticpop Onlineshop website.
2. Realization of the Contract
The offers in the plasticpop onlineshop are non-binding. When sending the order form which is in the online shop, the customer makes a binding declaration towards plasticpop that he wishes to purchase the content of his shopping basket. After plasticpop has issued a written order confirmation, the customer has a period of 24 hours (PayPal) or 8 days (bank transfer) to make a payment to us. The contract is only realized upon the merchandise being delivered by plasticpop. The customer can only place an order through the onlineshop. plasticpop reserves the right to refuse to accept the order without stating the grounds for this decision.

3. Right to Revoke / Revocation Instructions
You can revoke your contractual declaration in writing within a period of two weeks in text form (e.g. letter, fax, eMail) or by returning the item without grounds. The time-limit commences upon receipt of the instructions or the notification of the delivery date at the earliest. In order to adhere to the time-limit, it suffices if the revocation is sent to the following address in good time:

3.1 Consequences of a revocation

In the case of a valid revocation, the performances received by both of the parties are to be restored (in addition to any derived benefits (e.g. interest). If you are unable to restore the received performance to us in part or as a whole or if this is only possible in a deteriorated condition, then you are to provide us with a compensation for the value of the item. In the case of the item being delivered, this only has validity in as far as the deterioration of the item exclusively results from its inspection – such as would be the case in a store, for example –. You can also avoid the duty to provide compensation for the value if you do not treat the item as if it is your property and desist from all actions which could impair its value. You are to bear the costs for returning the item of its value does not exceed 40 euros or if the item is of a higher value but you have not provided a counter-performance or a contractually agreed part-payment at the time the order is revoked. The returning of the item incurs no costs for you in all other cases. You are to meet obligations to reimburse payments within a period of 30 days of having sent your revocation declaration.

We will accept shipments which are not prepaid. We shall however deduct the penalty postage from the payment reimbursement.

The right to revoke is not applicable for
- sealed merchandise if the seal is opened or damaged by the customer and for newspapers, magazines and pictorials.

4. Storage of the Contract Text
We store your order and the order data you entered. Should you require a printout of your order, you have the possibility of printing the order out, together with all of the entered data. You will also receive the order confirmation with all of the entered data by eMail if you have provided us with your eMail address.

6. Product Descriptions and Liability
Although all of the article descriptions in the onlineshop provided by plasticpop are as accurate as possible, they are non-binding. Product modifications by the manufacturer and errors with regard to descriptions, illustrations and price information are reserved. The article descriptions are normally based on information provided by the manufacturer. plasticpop does not provide a guarantee however that all of the information is accurate, complete, up-to-date or free from errors. The information provided in the onlineshop merely serves as information. Should a purchased product not correspond with the description, we will take this back as long as it has not been used and is in the original packaging. We will then reimburse you with the purchase price. No claims over and above the foregoing can be asserted. The purchaser assumes full responsibility for the safe and correct use of the product and releases plasticpop from possible claims in connection with the product and its incorrect usage.
7. Price, Delivery and Shipping Costs
The prices having validity on the order date will be invoiced. All of the product prices stated in the onlineshop are deemed to be in euros inclusive of the corresponding Value Added Tax. The order will be processed immediately upon it being received by plasticpop. The shipping costs (postage and packaging) are not included and are invoiced separately. All merchandise is only delivered after receipt of payment (advance payment and Paypal).
All periods of delivery stated in the onlineshop are non-binding, the exception being if something to the contrary is stipulated in the written order confirmation. If a period of delivery should be agreed to in a binding form, this period is prolonged by a reasonable extent in the case of a force majeure, impossibility or delay of the delivery when this is not the fault of plasticpop. The assertion of a claim for compensation by the customer is excluded in all cases.
plasticpop obligates itself to informing the customer of a non-availability of the order item without delay and to also reimbursing the customer a counter performance which has already been provided by the customer.

7.1 Packaging and shipping costs

plasticpop bears the packaging costs.
The shipping costs are as stipulated in the shipping costs list in the onlineshop under the link “Shipping and Costs”.

7.2 Delivery within Germany

In Germany, the delivery is made by DHL Express Vertriebs GmbH & Co. OHG. Experience with DHL has shown that an order is delivered in ca. 1-3 workdays. The customer is invoiced for any expenses incurred for undeliverable deliveries and/or returns which result from costs incurred as a result of the provision of an incomplete or incorrect address by the customer. We provide you with immediate eMail notification of delivery delays

7.3 Deliveries abroad.

We also deliver to other European countries. Deliveries are only made abroad against advance payment (SEPA or Paypal). The ordered merchandise is to be paid for in euros. Delivery is made after receipt of payment. Experience has shown that deliveries to neighbouring foreign countries take 6-8 workdays and that they are delivered by the local postal services. Delivery by courier service and insured parcels are possible upon request.

8. Value Added Tax
The prices include Value Added Tax.
9. Payment
The invoiced amount is payable in advance in euros, either by bank transfer (only in Germany), EU bank transfer (SEPA / European countries) or Paypal. If you chose bank transfer for your payment the invoiced amount is payable within a period of 8 days from the order date. If you chose Paypal it is payable within a period of 24 hours from the order date. Important! The PayPal account must be registered to an address in the EU. Because of the high fees, we do not accept Paypal payments from non-EU countries!

9.1 Problems during the payment process

Costs and/or fees incurred because of problems during the customer's payment process will be charged in full amount to the customer's account.

9.2 Payment Instructions for Pre-Orders

Pre-Orders are payable within a period of 8 days from the order date.
The time between the order date and the release date of items in a "mixed" order (order includes both in stock as well as pre-order items) may be partially several months. Therefore, please note: The order will only be sent when all items are available and in stock, the full invoiced amount is nevertheless payable within a period of 8 days from the order date.
10. Reservation of Title
The delivered merchandise remains the property of plasticpop until such time as the purchase price has been paid in full, irrespective of the expiry of the period of revocation.
11. Warranty
The statutory warranty rights have validity.
12. Data Storage
12.1 Personal data

Personal information is information which indicates your identity: name, address, postal address, delivery address, telephone number and eMail address. We only store your personal data in as far as it is necessary for the handling and processing of your order. We do not pass your personal data on to third parties. If you make use of our other services (e.g. subscribing to our newsletter), we require your approval to the storage of your data. You will receive a separate demand that you grant this approval, can inspect this data which we have stored at all times and also revoke your approval at all times.
You have a right of information, amendment, blocking and deletion of your stored data at all times and free of charge. Please contact or send us your request by post or fax.
When you enter your data, we store the data you provide in the customer form. We do not pass your data on to third parties. In the case of you placing an order, your personal data will be deleted after expiry of the warranty period of 2 years. This excludes our service partners which require the data in order for them to handle the order (the mail order company commissioned with the delivery and the credit institute commissioned with the handling of the payment). In such cases, the scope of the transmitted data is restricted to the absolutely required minimum.

12.2 Anonymised data

When you access our offers, information on the access (date, time, page looked at) is stored on our server. This data is not personal data, but is anonymised. It is exclusively evaluated for statistical purposes.

12.3 Use of Cookies

Cookies are used on some pages without us being able to point this out. Most of the browsers are so set that the Cookies are automatically accepted. You can deactivate the saving of Cookies or set your browser so that you are informed as soon as Cookies are transferred. The stored data is deleted again when you leave our website.
13. Final Provisions
German law has validity.
Data protection
We have done all in our power to protect your data from access by third parties so that we can enable you to shop with plasticpop securely. After all, your data and your trust are for us our obligation to provide the greatest possible security. plasticpop only stores the transferred data for the purpose of your orders and the handling of them. We refuse to pass it on to third parties with the exception of partners entrusted with the handling of the order!
Important instructions!
We transfer your data using a secure server with SSL (Secure Socket Layer) technology and a 128 bit encryption. This ensures that your data is transferred to us securely and in a form which cannot be read by unauthorized persons.

In this shop, information concerning the content of your shopping basket is stored in the Cookies so that this can then be called up the next time your visit the site. We require your customer data if you register with us or wish to place an order. If you are already a customer, you can simply register with your eMail address and personal password. The data which is stored in the Cookies means that you do not need to complete the form. The generated Cookies remain stored for a period of 14 days. You can also use your browser program to administer the acceptance of Cookies from this page and also block them if necessary.
